There’s the beef

A class-action lawsuit against Taco Bell was filed last week in federal court in California, claiming Taco Bell falsely advertised its products as "beef." The suit alleges that the fast-food chain actually uses a meat mixture in its burritos and tacos that contains binders and extenders and does not meet requirements set by the U.S. Department of Agriculture to be labeled beef.

aThe fast-food chain took out full-page ads in at least nine major newspapers and launched a YouTube campaign featuring its president Friday to proclaim its taco filling is 88 percent beef.

A false-advertising lawsuit filed last week that caused an online stir alleges the company’s filling doesn’t have enough beef to be called that. The lawsuit seeks to make the company stop calling it “beef,” and pay the suing law firm’s bill.

Taco Bell trumpeted “Thank you for suing us. Here’s the truth about our seasoned beef,” in the ads in Friday’s editions of the Wall Street Journal, USA Today and other papers.

The ads go on to say the rest of the filling is a mixture of spices and common food additives.

The lawsuit, filed in federal court in California, alleges the meat mixture has binders and extenders and does not meet federal requirements to be labeled beef.

Taco Bell denied those claims earlier this week but turned up the volume after a week in which the story spread like wildfire, making national headlines, creating an internet stir and even prompting a bit by comedian Stephen Colbert.

Experts say similar cases show the tempest in a tortilla is unlikely to hurt Taco Bell’s business, but the aggressive counter-attack is drawing some attention.

“It is unusual for a company to take this on and challenge the allegations so boldly,” said Gene Grabowski, chair of the crisis and litigation practice at Levick Strategic Communications in Washington. “A lot of companies are going to be watching how this turns out.”

The tone and scope of the campaign indicates Taco Bell is confident in its facts, Grabowski said. Companies typically shy away from taking facts in a legal dispute public.

The lawsuit, filed by the Alabama law firm Beasley, Allen, Crow, Methvin, Portis & Miles, doesn’t specify what percentage of the mixture is meat. The lawyer on the case, Dee Miles, said the firm had the filling tested and found it contained 35 percent beef. The firm would not say who tested the meat or give any other specifics of the analysis.

Taco Bell says the filling contains 88 percent USDA-inspected beef and the rest is water, spices and a mixture of oats, starch and other ingredients that contribute to what it calls the “quality of its product.”

The company said it uses no extenders to add volume to the filling.

Customers at a Taco Bell in parent company Yum Brands’ hometown of Louisville, Ky., were unruffled.

“I’ve eaten it for years,” said Greg Long as he grabbed a Beefy 5 Layer burrito Friday in Louisville, Ky. “I don’t care.”

“It tastes like ground beef from any fast-food restaurant to me,” said David Carey, who mostly cared it was quick enough to fit into his lunch break.

The plaintiffs would have to prove that most diners believe they are getting something other than what Taco Bell serves. Most customers realize taco meat has ingredients besides beef, Williams said.

In addition, the lawsuit cites U.S. Department of Agriculture guidelines for labeling ground beef. The problem? They don’t apply to restaurants. The USDA’s rules apply to meat processors – the companies Taco Bell buys its meat from.

Tyson Foods Inc., the company’s largest meat supplier, said it mixes and cooks the meat at three USDA-inspected plants.

So what’s in the meat, anyway?

Fast food often contains additives. That “isolated oat product,” for example, is usually used to help processed meat hang onto moisture and flavor. Other chains use them, too. McDonald’s, for example, says its hamburgers are all beef, but the hamburger chain’s ingredients list also includes additives and preservatives in many items.

Experts say similar ingredients are used in many processed foods sold in stores.

“There is nothing really Frankenfood in here,” said Karen Ansel, a registered dietitian and spokeswoman for the American Dietetic Association.

Nutrition experts say foods in their most basic, fresh form are healthiest. But Ansel said taco fans should be more concerned about salt than ingredients with long, complicated names.

“If they eat this, it is no worse for them than what they are getting anywhere else.”

Job fair planned for next week

The Coeur d’Alene Casino Resort Hotel, operated by the Coeur d’Alene Tribe near Worley, says it will need to fill more than 150 new positions to staff new venues because of its $75 million expansion.

To help bring those people on board, it will host a job fair from 10 a.m. to 2 p.m. Thursday at the resort’s events center.

A new restaurant will need almost 100 positions. A new spa will need an additional 26 employees, and the new hotel facilities will staff up to another 25 people.

Representatives from the different resort departments will be on hand to answer applicants’ questions, and human resources staff will be directing visitors and potential applicants through the fair.

There will be 15 application stations in the events center.

The large expansion, with a grand opening this spring, brings a significant need for new positions, including those at the entry level, and at the supervisory and mid-management levels. Almost all jobs offered will involve “front-line” service, meaning employees will have direct contact with resort guests. Some positions will require past experience.

“We continue to offer great opportunity for tribal members and all people in the region,” said chief executive officer Dave LaSarte-Meeks. “We’re adding to a great staff already here. We do take some pride in the fact that this is a great place to work in terms of wages and salaries and the benefits we offer. We expect a considerable turnout at the job fair.”

The expansion will create 98 hotel rooms and suites in two new wings. A 15,000-square-foot spa will be added, as will a steakhouse.

A centerpiece pub will have seating indoors and outdoors, and open to a vast front yard, including two natural amphitheaters.

The additional jobs will push total employment at the resort to about 1,150 people, and close to 2,000 for the Coeur d’Alene Tribe overall.

COEUR d’ALENE – The dream, though it bordered on a nightmare at times, is still alive.

Though the landscape has shifted since the economic collapse of 2008, homeownership is slowly but surely making its way back as the symbol of the American ideal.

No longer a quick money maker, national home sales are up as buyers are quietly returning to their pre-recession roots: Buying places they can afford for long-term nesting.

“We’re past the point where people think housing is a piggy bank,” said Jim Gillespie, Coldwell Banker Real Estate CEO, in Coeur d’Alene from corporate headquarters in New Jersey for the local branch’s annual award banquet Wednesday. “It’s back to being a lifestyle.”

And that’s a good thing, he said.

Gillespie’s speech highlighted recent positive trends in the real estate market, with bigger expectations for the coming year. It also dismissed recent reports thathomeownership might be a thing of the past, and that the real estate market was to blame for the country’s economic woes.

“In just a short period we had some struggles and all of the sudden these magazines are attacking the American dream,” he said, referring to several articles, including Time Magazine’s September cover story questioning the economic benefit of home-ownership. “To me that’s un-American.”

But it’s better to move forward, and people are.

After five years of dropping, home prices are up this year, as is consumer confidence, with the national household wealth growing by 2.2 percent in the third quarter of last year.

Also expected to rise in 2011 is the country’s Gross National Product, which could climb as high as 4.5 percent in some estimates. In 2010, 1.1 million jobs were added. This year, up to 2.5 million are expected to be tacked on. Auto sales have been steadily increasing since the government-sponsored Cash for Clunkers program expired, up 11 percent in 2010.

When the jobs and economy go, so too will the housing sales.

“What we’re seeing is a very slow and steady recovery,” Gillespie said. “It’s the best thing for the economy over a spike up, because that will just go down.”

The talk was part of the company’s award banquet at the Best Western Coeur d’Alene Inn, which the CEO has attended four years running, in part because the local branch has outpaced the national numbers. Its December 2010 business was up 25 percent from December 2009.

Carmen Myklebust, at the company for 21 years, said Gillespie’s appearance, becoming tradition, rubs off around the office.

“He’s awesome. He’s a down-to-earth guy,” she said. “It gave a positive outlook on the coming year.”

Knepper as manager of financial reporting and Janice Booth as senior auditor.
Knepper joins Coeur’s finance department as manager of financial reporting, she will be responsible for providing managerial direction and oversight in preparation for the company’s Securities and Exchange Commission and other reports and filings.
Booth joins Coeur’s internal audit department as senior auditor.
She will perform risk-based internal audits for the company’s U.S. operational locations and will determine compliance with company policies and procedures.

Julie Day, the Coeur d’Alene School District’s business manager and treasurer, has become the state’s first certified administrator of school finance and operations through the Association of School Business Officials International.
The association promotes high standards of business management practices and asked Day to be part of their beta testing group for the new designation based on her leadership involvement at the state level with Idaho Association of School Business Officials.

Porky G’s opens restaurant

Porky G’s Southern Style BBQ and Catering, which had been operating as a drive-up eatery, opened a sit-down restaurant this month.
Owners Gary Stinnett and Mary Warwick, of Spokane Valley, are leasing about 2,000 square feet of space at 1527 Northwest Blvd. The sit-down restaurant location also will offer drive-up service.
